SPA 124 Permit decision notice: Fromberg bank stabilization emergency watershed protection program extension and amendment

The Stillwater Conservation District is amending the Fromberg EWP Project (Project) in Carbon County (SPA 124 #: MI-01-24) to include placing 350 cubic yards of rip rap along 200 linear feet of the Clarks Fork of the Yellowstone River’s streambed and bank. The additional work is needed to better protect future bank scour and erosion during high water events and mitigate lateral migration of the river into infrastructure and residential properties. The channel impact area is estimated at approximately 0.08 acres beyond what was initially proposed and permitted. The additional 350 cubic yards of class III rock rip rap will be placed at or below the ordinary high-water mark. Materials will be sourced from river excavations at the Project site and used to construct the rip rap scour key. Willows should be planted throughout the rock rip rap bank to facilitate vegetation growth. The revegetation plan for the upland bench detailed in the original permit will also be extended to include the additional 200 linear feet of impacted streambank.
Based on the environmental review provided in the Draft EA, and, to the greatest extent possible, in accordance with all applicable laws, rules, regulations, and policies, FWP determined the proposed action (Alternative 2), will not have significant adverse impacts on the human environment associated with the proposed action and constitutes a reasonable and appropriate strategy to achieve identified objectives. Therefore, preparation of an environmental impact statement or EIS is unnecessary.
FWP hereby adopts the Draft EA as final and approves Alternative 2, the Proposed Action.
