The Fish, Wildlife and Parks Commission proposes to amend ARM 12.6.2208, 12.6.2215, and 12.6.2220 adding species of birds to the list of controlled species, adding the small spotted genet to the list of prohibited species, and adding rescue facilities with national or state agency affiliation to the list of organizations and individuals that may be permitted for possession of prohibited species.

Three hearings will be held on July 16-18 regarding the proposed amendment and adoption of rules regarding gray wolf management in Montana. Public comment regarding these rules must be received no later than July 25, 2008.

Due to intermittent ice on the Smith River that has caused the river to be impassable by recreationists, the Commission has adopted a temporary emergency rule closing the Smith River from Camp Baker to Eden Bridge.

The proposed rules are necessary to promote public safety and prevent delay of firefighting efforts by delegating the Fish, Wildlife, and Parks Commission authority to the Director of the Department of Fish, Wildlife, and Parks. By delegating this authority, the commission is assured that the public safety will be provided for and firefighting efforts will be expedited when a fire emergency occurs.

Notice of proposed rules to streamline the process for closing threatened fisheries when environmental condition, including drought, occur that warrant an angling restriction or fishing closure. Two public hearings will be held. May 7, 2008 in Bozeman, Montana at the regional headquarters and May 8, 2008 in Missoula, Montana at the regional headquarters.
