The Montana Fish, Wildlife & Parks Commission is seeking comment on a proposal that would continue to allow state officials to restrict or close waters to angling to conserve wild fish during times of drought.

The new rule makes official FWP’s existing fishing-closure policy and further explains FWP’s authority to adopt temporary angling restrictions or closures to protect a fishery when stream flows are low and water temperatures are high. The proposed rule also outlines when angling restrictions will be lifted based on improved conditions.

FWP closes streams to fishing when low-water conditions, and high temperatures combined with fishing pressure, would lead to an unacceptable level of stress on fish. Stress occurs when fish seek refuge in isolated pools, where the water is deeper and cooler, and where they are forced to compete for limited space and food. In some cases, fish can die from very high water temperatures, very low oxygen levels and reduced resistance to disease.

Comments, which must be received by May 16, can be sent to Michael McLane; Montana Fish, Wildlife & Parks; Fishery Division; P.O. Box 200701; Helena, Mont.; 59620-0701.
